Edgar Hoover Was F.B.I. Director & His Proposed Suspension Of Habeas Corpus For Illegals!

The Constitution says habeas corpus shall not be suspended “unless when in cases of rebellion or invasion, the public safety may require it.” The plan proposed by Hoover, the head of the F.B.I. from 1924 to 1972, stretched that clause to include “threatened invasion” or “attack upon United States troops in legally occupied territory.”

After the terrorist attacks of Sept. 11, 2001, President Bush issued an order that effectively allowed the United States to hold suspects indefinitely without a hearing, a lawyer, or formal charges. In September 2006, Congress passed a law suspending habeas corpus for anyone deemed an “unlawful enemy combatant.”

But the Supreme Court has reaffirmed the right of American citizens to seek a writ of habeas corpus. This month the court heard arguments on whether about 300 foreigners held at Guantánamo Bay had the same rights. It is expected to rule by next summer.

Derryck.
NYC.

<link rel='alternate' type='text/html' href='http://immigrationdilemaintheusa.blogspot.com/2011/06/j-edgar-hoover-was-fbi-director-his.html' title='J. Bush), and is still being used currently. That any foreigner who enters the USA illegally, does not qualify under the fifth amendment, for habeas corpus. Therefore, they can be arrested, thrown in prison, (especially law offenders) for very lengthy periods of time, without due process, or consultation with an attorney.

And held therein, until the Federal Immigration Administration repatriates them to their country of origin. Those whose country of origin cannot be determined, will be held in prison indefinitely!

Is this justice? I say it depends on who you ask here in the USA!

However, it is expected under International Law, that any illegal should be allowed to consult with an attorney before he/she is brought before a court of justice.

Because this is the civilized thing to do, and is in keeping with the Geneva Conventions as it pertains to Human and Civil Rights.

Derryck.
New York City.

The Hispanic/Latino Votes In America!

http://mimbari.livejournal.com/132568.html

June 13-2011.

The Hispanic/Latino Votes In America!

For decades both Democrats and Republicans have fooled the Hispanics into believing that REAL
Immigration changes will be legislated for, if they vote for either party.

Well, both political parties have failed miserably to enact a Comprehensive Immigration Bill so far!

Each time they use piece meal approaches to it, just barely touching the surface of this issue, and never getting anything real, or what comes close to a Comprehensive Immigration Bill, that both houses can approve, and the sitting president will sign.

The same applies to Barack Obama currently, who made the same promise to millions of un-documented residents here, that he will make a difference if they vote for him. He is almost to the end of his first four year term in office, and the immigration issue is still to be dealt with meaningfully.

Finally, personally I don't believe that Barack Obama will be able to get any Comprehensive Immigration Legislation passed in both houses. The Republicans control the Congress, and they will not vote in favor of any such legislation, just to embarrass and frustrate the Democrats into being unable to deliver on this promise.

This is the harsh reality for un-documented residents of all persuasions, most of whom are here legally, barely surviving, having to use illegal means to survive, and lives amidst fear of expatriation on a daily basis.

Heaven help us all!

Derryck.
NYC.

IMMIGRATION IS A FEDERAL RESPONSIBILITY!

http://mimbari.livejournal.com/132341.html

June 12-2011.

IMMIGRATION IS A FEDERAL RESPONSIBILITY!

No state has the authority to legislate Immigration Policy on it's own volition. The Federal Government via the Congress, is the forum that enacts such legislation ONLY.

And when passed, after being voted for in both Houses, and signed into law by the President. then it becomes the law of the entire fifty states.

ALABAMA-USA DRACONIAN IMMIGRATION LAW:

This law will allow for the harassment of all suspected illegal immigrants to be stopped and checked by The Police.

It prevents any Landlord from renting to them. It prevents access to Health Care, and to colleges. This discriminatory oriented type of law, takes the country back to the Jim Crow Era for all immigrants/aliens.

THE USA IMMIGRATION:

Any state that decides to enact such legislation, violates the Constitutional Mandate given to The Federal Administration/Government.

And any resident alien who is held in violation of such law in any state, MUST ensure, that an appeal is made to the US Supreme Court for a hearing, and a decision on that matter.

Derryck.
NYC.

The American Dream Was Intended For Whites Only!

<img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 240px; height: 320px;" src="http://1.bp.blogspot.com/_ELzGOx1H3Qw/THpaokoSzLI/AAAAAAAADGE/tO7aQVdO3PA/s320/DERRYCK-21+(Summer+2010).bmp" border="0" alt=""id="BLOGGER_PHOTO_ID_5510816747115170994" />
http://internationalpoliticalissues.blogspot.com/

August 29-2010:

The American Dream Was Intended For Whites Only!

Definition: The American Dream is a CONCEPT that hinges upon the following values!

* A land of opportunity for all.

* A country where there is liberty, freedom of verbal expression, written, personal, and social dissent that is protected under the constitution.

* A place where families can grow, prosper, send their offspring to college, and provide some financial security for retirement.

* And finally, a country where there is no barrier against personal religion, beliefs, sexual orientation, home ownership, employment equality, political affiliation, or ethnicity.

These are the CORE values and Beliefs that make up the American Dream.

This Dream Was Intended For Whites Only:

Yes, when this so-called dream was envisaged, it was the poor Whites who never had any land of their own, many were sharecroppers, illiterate, and down on their luck. So they felt that if they acquired some land to till and subsequently own. Then they will have something to call their own, and possibly hand down to their children.

Most realized after obtaining these lands that it was labor intensive, so having several children to help on the farm was absolutely vital for success. And this ultimately prevented their children from having a good Primary or Secondary education, because of the need for their help on these farms.

Industrialization & Mass Production:

When the USA became a major player in the manufacturing industries, it helped to propel many into the Middle Class. Because the wages earned therein, helped them save money for their children's college education, and holiday vacations.

And most industries were Unionized. So this too gave the workers bargaining rights/power to fight and win the necessary industrial regulations needed for safety on the job, Worker's Compensation for Injury on the job, and Health Care Benefits too.

Immigrants Also Aspired To This Dream:

The Statue Of Liberty was constructed to sell or represent symbolically the American Dream, which was sold to all those who wanted to come to America to start a new and productive life. The fallacy of finding work easily, getting your own apartment in the Big Cities, and being able to save for A Rainy Day, was the modus operandi that lured immigrants to this country.

Much to their dis-appointment as the true reality hit most of them when they eventually got here.

The Middle Class Is Almost Non-existent:

Today, with the recent Global Economic Crisis the American Middle Class, House Owners, and Mortgage recipients are in crisis. Most have lost their homes, some are on the verge of loosing theirs, and the Banks refuse to lend to anyone who is unable to pay EXORBITANT interests on any loan sought.

Big City Life Is The Reality In Most Developed Countries:

Most people reside in cities today, and most will continue to do so for the following reasons.

* It has most of the infrastructure that provides for easy travel, housing accommodation/rentals, grocery stores, shopping malls/stores, restaurants, movie theaters, and recreational facilities.

* Finding work that is suitable, or making a career of is also vitally necessary to most job seekers.

The suburbs do not offer most of these necessities. And owning a home in the suburbs can be very expensive too. Taxes, traveling expenses to and from work or pleasure, and raising a family therein is what most people who reside there prefer.

Derryck.
NYC.

Birthright Citizenship Concerns!

<img style="float:left; margin:0 10px 10px 0;cursor:pointer; cursor:hand;width: 240px; height: 320px;" src="http://4.bp.blogspot.com/_ELzGOx1H3Qw/TGqHM_wIhDI/AAAAAAAADFk/emtwU4EVe8o/s320/DERRYCK-21+(Summer+2010).bmp" border="0" alt=""id="BLOGGER_PHOTO_ID_5506362151755351090" />
August 17-2010:

Birthright Citizenship Concerns!

No child that is born in the USA should be denied US citizenship, because his/her parent was not a Legal US Citizen. After all, that child was not responsible for his/her illegal position if it is denied him/her.

If we are going to deny children US citizenship, then give all those illegals who qualify for legal status and citizenship, the legal means to become US citizens VERY SOON.

Comprehensive Immigration Legislation MUST Be Enacted:

For decades now, the US House & Senate have been pussy footing with various types of Immigration legislation that does not amply deal wih this question properly. And because of these erratic legislative bills/proposals in both houses. The Immigrants awaiting REAL Immigration Legislation Enaction have been side stepped, conned, cajoled, befuddled, and fooled, by both Democrats and Republicans everytime their representatives' terms in office comes to a close, and they want to be re-elected.

So they bombard constituents both Legal and Illegal with promises to deal finally with this issue. Even the Obama adamistration has done this disservice to us all. And I am sure that he too will leave The White House without getting any Comprehensive Immigration passed in both houses, and signed into law.

Since former president Ronald Reagan pardoned thousands of illegals, making them legal immigrants in this country. The Democrats and Republicans have used this issue to divide the American people generally, by criminalizing illegal immigrants for their own political agenda.

Enough Is Enough. And both parties

MUST agree to abide by these rules and regulations also.

However, in the current quest to deal with Global Tax Evasion and

Transparency for Banks, it is incumbent upon banks to do the following.

* When asked by a foreign country's authorities to submit upon request, and in reasonable time, the bank account deposits and saving of a certain client. (Some versions of the theory, particularly those circulating in Canada, assume only the United States and Canada would be included.) The hypothetical currency for the union is most often referred to as the amero.[1][2] The concept is modeled on the common European Union currency (the euro), and it is argued to be a natural extension of the North American Free Trade Agreement (NAFTA) and the Security and Prosperity Partnership of North America (SPP).

Conspiracy theorists contend that the governments of the United States, Canada, and Mexico are already taking steps to implement such a currency, as part of a "North American Union (NAU)".[1] No current members of any country's government have officially stated a desire to create such a body, nor has anyone introduced a common currency as part of this concept.[3]

Basis and origin

The letter A inside a circle. The proposed symbol for the amero, originally chosen by Herb Grubel in "The Case for the Amero" [4]

The idea for a North American currency union was first proposed in 1999 by Canadian economist Herbert G. Grubel.[1] A senior fellow of the conservative Fraser Institute think-tank, he published a book titled The Case for the Amero in September 1999,[2] the year that the euro became a virtual currency. Another Canadian think-tank, the C.D. Howe Institute, advocates the creation of a shared currency between Canada and the United States.[5]

After the report came out, center-left nationalist groups[citation needed] in Canada and America expressed their opposition to any currency union because they view it as an attempt by American businesses to gain access to Canada's extensive natural resources while dismantling the nation's social services.[1] The 100,000 member strong Council of Canadians, a progressive advocacy group, has declared one of its central issues to be the threat of "deep integration".[1]

Dr. Robert Pastor, in a 2001 book[6], suggested a common currency should be a foundation of "macro economic cooperation" among the three NAFTA countries. However, the 2005 Independent Task Force on North America, which he chaired, did not recommend a common currency, nor does Pastor in the section for additional and dissenting views suggest a common currency should be a goal. [1]

NAFTA

Canada

One argument is that it would save up to $3 billion in currency transactions.[7] The same authors also stated that Canada's GDP could rise by up to 33 percent in a 20-year period given the adoption of a single currency.

The idea of a common currency has historically been unpopular in English-speaking Canada, in comparison to the French-speaking province of Quebec where it has received more support. A 2001 opinion poll found that in Quebec over 50 percent of respondents favored the idea of a shared currency, while in the rest of Canada a majority of respondents opposed the idea. [8]

Mexico

The possibility of a monetary merger has also been discussed in Mexico as a natural step to take after NAFTA.[9] Former Mexican president Vicente Fox echoed that view and expressed his hope for a greater integration of Canada, Mexico and the United States, including an eventual monetary union, while on a 2007 promotional tour for his book "Revolution of Hope."[10

Support in other regions

Lower levels of currency cooperation have been practiced in the Americas before. Some nations such as Argentina, Brazil and Canada have at times tied their currency to the U.S. dollar. Some of them, such as Aruba, Bahamas, Barbados and The Netherlands Antilles (guilder) still do.

The U.S. dollar is officially accepted alongside local currencies in El Salvador (since 2001), Nicaragua, Peru, Honduras, and Panama, although in practice two of these countries (El Salvador and Panama) are fully dollarized. In 2000, Ecuador officially adopted the U.S. dollar as its sole currency.

Unofficially, the U.S. dollar is treated as a de facto secondary currency in much of Central America and the Caribbean along with parts of South-East Asia, specifically Vietnam.

Currency integration is also one of the many long-term aims of Unasur (Union of South American Nations), a supranational organization comprising all the sovereign nations of South America, modeled after the European Union.

Criticisms and problems

Opposition to a North American currency union exists high up in the governments on both sides of the Canada–United States border. Herbert Grubel, the first proponent of the amero, admits that American officials show no interest in the topic.[1] He concedes that "there wouldn't be very much benefit for the United States" in an amero.[1] Likewise, the Canadian Department of Finance strongly opposes the creation of a common currency with the United States, citing the loss of economic sovereignty. In briefing documents to Minister of Finance Jim Flaherty, finance officials concluded:

"A North American common currency would undoubtedly mean for Canada the adoption of the U.S. dollar and U.S. monetary policy. Canada would have to give up its control of domestic inflation and interest rates."[12]

Trade-offs

From the point of view of the Canadian and Mexican governments, a major obstacle to the creation of a unified currency is the sheer dominance of the United States in any such union. Unlike any country in the EU, the USA has a larger economy than the rest of its respective continent/union combined.[citation needed]

A paper from University of California, Santa Barbara puts forward the idea that the United States simply has too many advantages from the status quo to move toward a single currency.[13] The United States dollar already acts as a global currency, meaning any transition to a 'new' currency would risk compromising this position and could cause a shift toward the euro, yen or yuan.[citation needed] The U.S. dollar is currently being used in over half of all the world's exports, double the total United States foreign trade. The adoption of the amero could threaten the seigniorage that the U.S. currently gains from its dollar. While seignorage would still be gained from the amero, this would be shared among the Bank of Canada, the Federal Reserve, and the Banco de México. Therefore, even if the amero were used just as much as the U.S. dollar, the advantages would be shared among two or more countries, and not exclusively earned by the United States.

Differing economies

Several problems could arise in regards to macroeconomic management. By submitting to a common currency, the countries would lose considerable autonomy in the management of the currency itself, including the setting of interest rates. Amongst the three potential participants, there is considerable difference in policy which would have to be reconciled.

Debt is a factor affecting currency prices. As of 2008, the debt of the United States continues to increase, while the debt of the Canadian federal government is being reduced. [14] This is a clear advantage for Canadians and it would not be reflected if the currencies were to merge. The importance of commodities also factors into this equation.

A concern with any unified North American currency is the differing economic situations between each country. The Eurozone is broadly similar being service-based economies[15] based on high public spending (compared to the United States), high taxes and wealth being created by the sale of goods and services. North America on the other hand has three distinct economies; one based mainly on agriculture and manufacturing, with a demand for free trade (Mexico), another based on services such as retail, with low taxes and low public spending (United States), and a third based on services with higher taxes and higher public spending, with a large sector in primary goods such as oil, mining and lumber (Canada).[citation needed]

Political mandate

Lou Dobbs, a reporter and commentator for CNN, has suggested a "North American Union" is being implemented, without the knowledge and consent of the majority of the people who would be affected by this.[16] This Union, he and others claim, would include a common currency.

In 2006, Conservative Caucus Chairman Howard Phillips, WND columnist and author Jerome Corsi, activist Phyllis Schlafly, among others, reportedly formed a coalition against a North American Union.[17] On January 22, 2007, Republican Representatives Virgil Goode of Virginia, Tom Tancredo of Colorado, Walter Jones of North Carolina, and Ron Paul of Texas were among the 43 federal lawmakers who introduced H. CON. RES. 40, a resolution advocated by the coalition, that expressed:

"The sense of Congress that the United States should not engage in the construction of a North American Free Trade Agreement (NAFTA) Superhighway System or enter into a North American Union (NAU) with Mexico or Canada."

Amero coins!

In August 2007, rumors and conspiracy theories began circulating across the Internet regarding alleged United States Treasury-issued "amero coins".

The inspiration behind these rumors may have been the posting of images of medallions created by coin designer Daniel Carr.[1] Carr, who designed the New York and Rhode Island 2001 statehood quarters, sells medals and tokens of his own design on his commercial website, "Designs Computed" (also known as "DC Coin").[1] Among his designs are a series of gold, silver and copper fantasy issues of "amero coins" ranging in denomination from one to one thousand.[1] The medallions have the legend "Union of North America" on the back with his company's logo, a stylized "DC",[18] in small type.[19] Concerning his "amero" designs, he mentions on his website:

My goal with these coins is not to endorse a Union of North America or a common "Amero" currency. I fully support the United States Constitution, and I would not welcome (in any form) a diminishment of its provisions. I expect that these coins will help make more people aware of the issue and the possible ramifications. I leave it up to others to decide if they are in favor of, or against a North American Union. And I encourage citizens to voice their approval or disapproval of government plans that impact them.[20]

Unauthorized postings of images taken from his website have been reposted widely across the Internet, often being used as supposed "proof" of the amero coinage. Notably, white nationalist and former Internet radio talk show host Hal Turner ran a full article on his website about the "amero coin", claiming to have arranged for a United States Government minted "amero" to be smuggled out of the United States Department of the Treasury by an employee of that organization.[21]

Following Turner's assertions of federal minting of ameros, a web site marketing the curio coins released a statement debunking Turner's claims of a government cover up regarding Daniel Carr's amero products.[22] The urban legend investigating Web site Snopes also ran a further counter to Turner's claims, stating "neither the U.S. Mint nor the U.S. Treasury has a hand in creating these 'Ameros'. These coins are merely collectibles offered to the buying public by a private company in the business of manufacturing such curiosities."[23] Hal Turner claimed that Carr's website had been created in haste in a matter of days expressly to discredit his claim about the coinage. [24] However, Carr's designs have been available through his website since 2005,[25] and according to a WHOIS search at Network Solutions, the domain "dc-coin.com" was registered by Daniel Carr on 27 September 2005.[26] In October 2008, Hal Turner released a video showing an apparent 20 amero coin, with claims that shipments of the currency had been sent to China. [27] Yet the coin in Hal Turner's video is identical to a medallion on Daniel Carr's "dc-coin" website, listed as "UNA 2007 20 Ameros, Copper, Satin Finish". [28]

Amero bills

On December 3, 2008, Hal Turner's blog featured what he claimed were genuine "amero bills". He displayed photographs of purported 20, 50 and 100 amero notes. Turner did not identify how he obtained the images, saying only that "once again, my sources have come through." He claims that the "new currency is already being printed and quietly distributed around the world."[29] The website Snopes.com suggested Turner was "beating the same tired, apocryphal drum" with his new claim.[23] A user at the Abovetopsecret.com discussion forum alleged that these images are art from the Flickr user aleatorysort,[2] who created them as an artistic political commentary[30], and were therefore not actual currency.

Green Cards Are For Millionaires ONLY!

<img style="float:left; Anti Mexican Violence!

Recently, we saw on television how South Africans living along the border regions with Zimbabwe, had some very severe altercations with the Zimbabweans, and other neighbors who fled into South Africa to seek refuge from violence and death.

Thousands of Zimbabweans were killed, beaten, severely and bodily wounded, by very angry South Africans who claimed that they (the foreigners), were taking away their jobs, causing South Africans to loose those same jobs to foreigners, who were prepared to work for less.

After some weeks of violence and death had elapsed, the South African government then sent in the military to quell the violence, and create a climate of calm. But the resentment for foreigners are still rife.

Mexican Refugees:

With the ongoing Drug Cartel Wars among themselves, innocent civilians are being coerced, threatened, killed, and homes burnt on a daily basis, in the thousands. Thus creating a regional crisis, especially in Tijuana, the hot spot of this violence for territorial control.

This ongoing war has caused thousands of Mexican civilians and military personnel to seek asylum here in the USA. If this crisis continues, we will indeed have a situation here like in Palestine and Israel, The Sudan and Darfur, Zimbabwe and South Africa.

And the general feeling among many Americans polled currently, is totally against any asylum for Mexicans.

Derryck S. Many of whom have lost their jobs, homes, and are unable to pay their college tuitions, mortgages, and other daily houshold espenses.

But yet, millions of Americans and other 'would be' American citizens, who are receiving Public Assistance locally, have not received any Federal Assistance from the outset from the First Rescue Package that was passed under George W. Bush, nor do I see any coming to us P.R.U.C.O.L.,or (un-documented) residents this time around.

We are here, have been here for years awaiting Federal Legal Residence Status approval, still have to eat, pay our bills (somehow), and are the ones who have no way to turn for any help or financial assistance in this crisis.

I can also envisage that with this crisis, no Immigration Legislation that would cater to our needs and status is afoot, or may never even be considered either. Even though thousands of us have campaigned, volunteered, and advocated for you all throughout the campaign for the presidency. Online, at your campaign headquarters nationwide, and anyway we felt it necessary to get out the vote.

But yet, after all of this work and anticipation for a better lot for us, we are being overlooked once again. And this Rescue Plan does cater to us either!

I am worried, insulted, and apprenhensive for our collective future, as this crisis gets worse.

Currently many South Americans, Mexicans, and others, have been repatriated to their homelands, via Immigration sweeps at some job sites. Some are thrown out of homes or apartments they are renting with family and freinds, because they can no longer afford to pay the rent.

So what about us Mr.President!

Derryck S. The following MUST be done NOW:

* The federal government MUST allocate a few million dollars to that fund, ANNUALY:

* And all presidential candidates must address this issue, and pledge to do so, or increase this much needed additional funding, whomever get elected to the White House in 2009.

Derryck.
NYC.
----------------------------------------

WORD-UP:

Does The US President Have Any Influence On The National Economy?

The USA is a FREE MARKET economy. And how the wealth is distributed throughout this economy.

The presidency may have some political influence, depending upon which corporation or corporate block, have the most sway in the free market.

But by and large, the consumer masses, by virtue of the demand and supply curve in the economy, will influence how this economy will operate nationally and globally.

Derryck.
NYC.
------------------------------------

WORD-UP:

The Strategy For Democrats In This Campaign!

For those of you who are watching the candidates as they campaign this year. May have observed how differently they sell themselves to the various states on the issues. But keep in mind this. No candidate could EVER get into the DETAILS fully in any campaign speech, like the media tries to highlight.

That would be time consuming, boring, and impractical. So each candidate tailors his or her message to the economic concerns of that particular state, he or she is campaigning in.

That is a more realistic approach. And it seems to work for Sen. Barack Obama right now!

However, if or when Barack Obama gets the nomination, then you will see how more detailed he would be, because he would then be campaigning for the National electorate's vote.

Derryck.
NYC.
---------------------------------

February 16-2008:

WORD-UP:
A Bomb That Saves Lives:

This so called 'Life Saving Bomb,' that the US military has now developed, will hit the desired target or targets with surgical precision. These bombs are much smaller in mass, thus creating less collateral and human damage if it misses.

Bull Shit:

All bombs are created to KILL people or DESTROY buildings, bunkers, military infrastructure, etc.

And when a precision guided bomb misses it's target, people die, buildings are destroyed, and extreme damage to land, terrain, or infrastructure is possible.

So telling people that this smaller and more precise bomb will be better equipped to hit the target, is TOTALLY irresponsible, and incorrect.

All bombs kill and maim people PERIOD!

Derryck.
NYC.

The TRUTH About The FLU VACCINE:

WORD-UP:

The proverbial truth about the flu vaccine is basically untrue, for the allowing reasons:

* None of the known flu vaccines that your doctor recommends could guarantee immunity from the flu.

* People have contracted the flu after taking the flu vaccine already:

* At every changing season, the flu virus is able to re-invent itself, to defy the known and prescribed medications that we are told to use for it.

Thus making all known medication currently IMPOTENT, at protecting anyone from the flu.

And these are the HARD FACTS about the FLU.

Derryck.
NYC.

AMNESTY Defined & Explained:

January 06-2008:

What Is AMNESTY?

Dictionary Definition:

A period during which offenders are exempt from punishment:

A warrant granting release from punishment for an offence:

The formal act of liberating someone:

Grant a pardon to (a group of people):

According to Rudolph Juliani. Only thirty days or (a temporary visa) would be granted to anyone applying to enter the US for business or visitation. This visa will not be extended.

2. No permanent residency will be allowed to anyone who is HIV positive, and has been allowed to visit here within the USA, after his or her thirty days sojourn is over.

3. The HIV positive individual MUST also prove that he or she would not be a health risk to US nationals while staying within the USA.

4. He or she MUST also prove that he or she would be Self-sufficient in medications while staying here, and would not have to access the local hospitals or institutions for medical care for HIV.

5. And if so, must be able to show that he or she could afford to pay for those medications while in residence here.

6. Any HIV positive individual who is seeking asylum, and is granted one, MUST also give up his or her intention to apply anytime in the future for permanent residence status or the Green Card.

7. And if the HIV positive person is allowed to stay in the USA as per Asylum, MUST be able to PROVE that he or she would not be a financial burden, or MUST prove that he or she could afford to pay for all his or her HIV medications while in residence here.

CONCLUSION:

This monstrous proposal is just another one of those INHUMANE, MORALLY DEPRAVED, and PREJUDICAL attempts to debar HIV positive individuals from entering the USA, and acquiring permanent residence status here.

And what do these proposals have to do with Homeland Security?
It also shows just how much the Ronald Reagan mentality is still very much alive and well within the USA today!

Derryck S. Griffith.
New York City.
----------------------------------

Senators-White House announce immigration deal-2007:

By Associated Press
Thursday, May-17-2007 -
Updated: 04:48 PM EST

WASHINGTON - The White House and key senators in both parties announced agreement Thursday on an immigration overhaul that would grant quick legal status to millions of illegal immigrants already in the U.S. It would also fortify the border.

Immigration reform:

President Bush said the proposal would "help enforce our borders but equally importantly, it’ll treat people with respect." "This is a bill where people who live here in our country will be treated without amnesty but without animosity," Bush said. The compromise came after weeks of closed-door negotiations that brought the most liberal Democrats and the most conservative Republicans on immigration issues together with Bush’s Cabinet officers to produce a highly complex measure that carries heavy political consequences. It still faces a long legislative struggle and its passage by the Senate or House is far from assured.

The plan would create a temporary worker program to bring new arrivals to the U.S and a separate program to cover agricultural workers. Skills and education level would for the first time be weighted more heavily than family connections in deciding whether immigrants should get permanent legal status. New high-tech employment verification measures would make sure that workers are here legally. Sen. Edward M. Kennedy of Massachusetts, his party’s lead negotiator on the deal, hailed it as "the best possible chance we will have in years to secure our borders and bring millions of people out of the shadows and into the sunshine of America."

Anticipating criticism from conservatives, Sen. Arlen Specter, R-Pa., said, "It is not amnesty. This will restore the rule of law." The accord sets the stage for what promises to be a bruising battle next week in the Senate. Senate Majority Leader Harry Reid, D-Nev., called the proposal a "starting point" for that debate and said the measure needs improvement. "I have serious concerns about some aspects of this proposal, including the structure of the temporary worker program and undue limitations on family immigration," Reid said in a statement.

The breakthrough came when negotiators struck a bargain on a so-called "point system" that prioritizes immigrants’ education and skill level over family connections in deciding how to award green cards.
The immigration issue also divides both parties in the House, which isn’t expected to act unless the

Senate passes a bill first.

The proposed agreement would allow illegal immigrants to come forward and obtain a "Z visa" and - after paying fees and a $5,000 fine - ultimately get on track for permanent residency, which could take between eight and 13 years. Heads of household would have to return to their home countries first.

They could come forward right away to claim a probationary card that would let them live and work legally in the U.S., but could not begin the path to permanent residency or citizenship until border security improvements and the high-tech worker identification program were completed.

A new temporary guest worker program would also have to wait until those so-called "triggers" had been activated. Those workers would have to return home after work stints of two years, with little opportunity to gain permanent legal status or ever become U.S. citizens. They could renew their guest worker visas twice, but would be required to leave for a year in between each time.

Democrats had pressed instead for guest workers to be permitted to stay and work indefinitely in the U.S. In perhaps the most hotly debated change, the proposed plan would shift from an immigration system primarily weighted toward family ties toward one with preferences for people with advanced degrees and sophisticated skills. Republicans have long sought such revisions, which they say are needed to end "chain migration" that harms the economy, while some Democrats and liberal groups say it’s an unfair system that rips families apart.

Family connections alone would no longer be enough to qualify for a green card - except for spouses and minor children of U.S. citizens.
New limits would apply to U.S. citizens seeking to bring foreign-born parents into the country.

© Copyright 2007 Associated Press. Keeping him on the air is essentially sanctioning by CNN which is why we’re asking CNN to remove Dobbs from his very public platform."

Referring to immigration advocates and San Francisco Mayor Gavin Newsom, Dobbs said, "They might as well work for Hermann Goering; I mean, they’re running so much propaganda, trying to confuse the debate, the national dialogue, by talking about immigrants rather than illegal aliens and legal immigrants.

It’s mindless beyond belief." (It is not clear whether Dobbs actually meant Nazi propaganda minister, Joseph Goebbels, rather than Goering – who was actually commander of the Nazi Air Force – the Luftwaffe – and who was the highest ranking government official who issued written authorization for the Holocaust) In a weekend speech, Mayor Newsom reiterated San Francisco’s policy of not assisting federal officials with immigration-related raids.

Aronoff says the Jewish community should be particularly concerned about Mr. Dobb’s comments. "Comprehensive immigration reform should involve a civil, national conversation that includes the American people and professionals who actually work with refugees, asylum-seekers and immigrants; make policy, or both – not dominated by TV blowhards, whose raison d’etre is entertainment.

Setting himself up as an arbiter of common sense may make for amusing television, but it is insulting to the serious matter of immigration reform."

Failure To Integrate-Breeds Prejudice-Hate & Suspicion!

January 22-2007:
http://my.opera.com/BringBaka/
http://360.yahoo.com/derryck_sylvester

Failure To Integrate-Breeds Prejudice-Hate & Suspicion:

In every culture where there are several different ethnic groups, that choose to live in separate communities, or neighborhoods, the festering of suspicion, distrust, and hate takes root. Coupled with those attitudes, is the refusal to learn the national or predominant language, and communicate in that language on a daily basis, in order to become proficient in it. Also creates the inability to understand how the mainstream society view outsiders, or those who fail to fully integrate into the mainstream culture.
When ethnic groups are separated into communities deliberately, by virtue of their language, or cultural heritage, tension becomes inevitable, and in time, ethnic hate, or ethnic suspicion takes root within these different groups.
Plural communities such as New York City, that historically was able to tolerate, integrate, and encourage the learning of English as the national preferred mode of communication, for economic and upward mobility. Plus social cohesion is encouraged, so that such ethnic tensions are kept to a minimum.
Political, Social, and Religious leaders must also deliberately encourage their flock or communities to access those services, and facilities that will help them to be fully integrated into the mainstream of things. In communities where the above modules are not used or promoted, ethnic tensions eventually emerge. And violent gangs are created. The victimized personality attitude becomes the criteria used by those who feel incompetent, ignored, dis-enfranchised, dis-regarded, or less than those they perceive as privileged.
Inner Cities of Chicago, and California are cases in point!
Derryck S. W. Bush:

President George W. Bush claims that an immigration bill is now on the floor of congress. He would like them to correct whatever differences they have with that bill, (both houses), and come up with a comprehensive bill for him to sign.

In other words, according to this statement, I am willing to assume that he meant that regardless of how he personally feels about the immigration issues. He is willing to sign any bill right now, that Congress and the Senate approves.

However, if such a bill ever gets formulated, how would provisions be made to accommodate Border Security. The Guest Worker Programs, Amnesty, and Un-documented aliens. The organizers are based in Mexico, and they are being supported by several Trade Unions, Church groups, and affiliated bodies or worker's organizations.

They are expecting illegal Mexicans and un-documented Mexicans here in the USA to come out in force in support of this effort. The issue according to the NPRNews.com Radio, is to send a signal to the George W. Bush Administration in Washington, that they are against the bill which intends to criminalize illegal immigrants in this country.

These people are contending that to be un-documented, or illegal, with no history of any felony, or of breaking any laws while here in the USA illegally, does not warrant a criminal status or category.

And that aspect of the current legislation in process, must be amended or revamped immediately.

Personally, I cannot see the rationale for boycotting American products, when those same products are produced or manufactured by and large, by those who employ illegal aliens. And these same illegal aliens need the cash/wages to assist their families here, and in their homeland Mexico, to survive near starvation.

I sincerely hope that the planners/organizers of this demonstration really re-consider the gravity or impact it will have on the legalization process, for the same people they are advocating for!

A Spanish Version Of The Stars Spangled Banner:

A new Latin version of the USA's National Anthem was introduced today, targeting the Latin community. The intent was to help those who cannot speak English, to still be able to sing the US National Anthem.

Personally, I believe that The National Anthem of any country, must be sung in the pre-dominant language of that country or culture. That is the reason why it is a National Anthem.

To do otherwise, or to compensate a sub-cultural group in that country, by allowing homage to be paid or sung in the language of that sub-cultural group, would de-emphasize the importance and true meaning of that anthem.

Therefore, I agree with President George W. Entered The USA without an official Passport or a Visa:

3. Legal sponsorship, and disappearing afterwards from sponsor's supervision or knowledge:

4. Entered the USA via forged documents:

5. Seeking asylum and risking deportation:

6. Seeking asylum and automatically given it, after reaching the USA shores safely, eg (The Cubans):

7. Crossing the Mexican/American borders illegally, to seek employment:

8. Trafficking of male and female prostitutes from Eastern Europe, or (the former Soviet Union Satellite countries):

Each of these known categories need some explaining. And I shall try to do so,with the best of my knowledge and ability.

Categories Explained:

Category#1:

When a person legally enters the UA, that person/s would have satisfied the immigration authorities with the necessary requirements, such as a heath check, a visa, a passport, a tax clearance from their home country, and a financial report that validates his/her ability to sustain his/herself while in residence here.

Category #2.

When a person enters the USA without the above official requirements, he or she is violating the immigration requirements, and would be categorized as an illegal alien/immigrant.

Category #3.

a. When some foreigner is sponsored by some employer or American national, he or she is the sole responsibility of that sponsor. Current laws vary regarding the types of sponsorships. But importantly, the sponsor must show valid legal reasons why he or she is sponsoring that foreign born person.

b. And what he or she is expected to do for them, while here in the USA.

c. And if he or she has the necessary financial ability to support or finance that person's welfare while in The USA.

d. And is also legally responsible for any felonious misdeeds that this person may have committed. while here in the USA.

Category #4.

a. When a person/s enters the USA with forged documents, and manages to escape detection by the immigration authorities. Then that person/s is an illegal immigrant/alien, and could be apprehended and deported.

Categories #5 & 6.

a. When a person enters the USA legally or illegally seeking asylum, is doing so in good faith, and is also risking deportation.

b. That person will have to get legal representation by a Lawyer/Attorney or Advocate, and show valid or substantive documentation to support his or her claim for asylum.

c. The only people who are granted almost immediate asylum, if they manage to reach America's shores, are the Cubans. And that arrangement has legal approval.

Category #7.

When persons cross the Mexican/American border illegally, they could be apprehended and taken back to Mexico, or even arrested and deported. This situation is currently hotly debated, because most or all of these illegal entrants, are seeking seasonal employment, in and around the territories in that geographic region.

Category #8.

Trafficking of men, boys, or women from Eastern Europe, or (the former Soviet Union satellite countries), into the USA for prostitution work, is illegal, and punishable under current USA laws pertaining to that situation.

This phenomenon is also being done by the Chinese underground railroad, that deals with illegals whom they promise a better way of life, with financial gain for self and family here in the USA.

And whom are at the mercy, and personal risk of death, if they fail to repay the travel expenses to their facilitators, when they get to the American shores, and discovers that all that was promised was a fallacy.

SOLUTIONS:

A Comprehensive Immigration Law/Bill is needed in the USA:

What this country need, is A Comprehensive Immigration Bill that guarantees the following:

1. Acceptance of any foreigner, who is not a security/national threat to the country, and has satisfied the Legal Immigration entry requirements.

2. Grant residence status to those who have satisfied the above requirements: Displayed respect for our national constitution & local laws: And have not committed any felonious act/s while in residence here.

3. Grant Legal Residence Status to those who have overstayed their visas, and are unable to return to their homeland, for fear of reprisals, retribution, and/or financial inability to re-enter the USA.

4. Seeking asylum for political, religious, or racial/ethnic reasons, should be considered eligible for legal residence status.

5. Any person/s who have tested HIV positive while living in the USA: Have entered the country legally: Have been residing here for over one year prior to being tested HIV positive, should be granted legal residence status, on humanitarian grounds.

6. Ensuring that our national borders are adequately policed: Persons entering or leaving our sovereign territories, must provide the necessary legal papers or identity.

7. All immigrants, legal or illegal must be allowed to access medical/emergency assistance from any hospital or clinic in The USA, without being asked for his/her legal residence status documents.

Om Shanti.
Derryck S. Griffith.
Educator-Advocate & Blogger.

http://my.opera.com/BringBaka/
http://www.myspace.com/derryck_mimbari
http://Mimbari.neatvibe.com
http://SpeakUpOrShutUp.neatvibe.com

CONCLUSION:

The current immigration discussions within the US House Of Representatives & Senate, has far reaching consequences to those who represent the regions/constituencies, that have large volumes of illegal Spanish Speaking residents.

This debate or concern is only seen as important in communities with such large volumes of this ethnic group/s, that residents in those communities feel insecure, threatened economically, and plays into the hands and stereotypes, that the general culture portrays about these people.

Such as criminal elements, undercutting jobs, providing services for less than minimum wage, and does not pay taxes.

Most of these fears however, are unfounded because most illegals pay the prescribed taxes via their wages. Even though most of their employers do not submit these taxes to the Feds or State governments as they are legally supposed to do. This may be because most of these employees are illegals without official SS identity numbers, or has forged documentation.

Also, some employees are working 'under the books,' which means, that taxed contributions are not shown in the employers payroll. Hence, does not require them to submit any taxes to the Feds or State authorities.

Finally, this debate overshadows the Immigration Dilemma that the USA has allowed to fester for decades, because it helped Big & Small businesses alike, to manipulate and exploit illegal workers, with poor wages, terrible working conditions, no health care, and the ability to hire and fire them at random, without valid or substantive reason/s.

Does The Erection Of Walls Really Work:

Ever since the dawn of organized warfare and tribal protection, humans have erected walls to protect themselves from hostile invaders. But history has also shown us, that in time, those walls were breached by the same invaders, they were built to keep out.

Currently, the Border fence that is being constructed in Israel is supposed to protect Israel from 'suicide bombers' getting in to kill Israeli's.

But that has not stopped the suicide bombers from getting in from time to time. And rocket launched missiles cannot be prevented from reaching their targets either. Because these rockets could ascend any wall.

In fact rockets could overshoot any wall.

As for the border fence between Mexico and the US regions. This fence is also perceived to be a deterrent for invading Mexicans, from illegally entering the US. This fence too will in time prove to be in-effective from stopping any incursion into US territory.

The problem in Mexico is increasing un-employment within the rural communities. Very little economic development that will assist the poor and under-privileged, to acquire gainful employment.

And if this situation continues, the native Mexicans will try every conceivable thing, to gain entry into this country, in order to find work to support their starving and destitute families.

I Report-You Decide!

Derryck S. Change the Title II formula to eliminate or reduce the statewide component of the Title II base formula (i.e, eliminate or change “80-20”).
The formula for determining the Title II base awards (80-20) is calculated by using a state distribution factor and a non-EMA distribution factor. Including a statewide component in the base funding formula recognizes the role of states in coordinating a statewide response to the epidemic. Eliminating or changing 80-20 would reduce funding to states that are heavily burdened by the epidemic.

(12)
CARE Act Reauthorization:
Proposals of Concern to New York
Impact of elimination of “80-20” on New York State:
• Based on the FY 05 award, New York State would lose an estimated $22.8 million, or 56% of the Title II base award.
• Compared to all states, NYS would suffer the highest loss in dollars.
• The impact of this loss to New York State would be disastrous in terms of services for persons with HIV/AIDS.
7

(13)
CARE Act Reauthorization:
Proposals of Concern to New York
2. Eliminate or drastically change hold harmless provisions. The “hold harmless” provisions of the law limit the loss of resources to a jurisdiction over time in order to avoid substantial reductions in funding and the devastating effects associated with dismantling service programs.

(14)
CARE Act Reauthorization:
Proposals of Concern to New York
3. Shift funds to southern states.
This proposal is based on a widely held perception - that the HIV/AIDS epidemic has “shifted” from some states to others - which is not true. While the epidemic has expanded, a few states continue to carry the heaviest burden associated with the epidemic. More than half of all persons with HIV/AIDS in the U.S. reside in five states (New York, California, Florida, Texas, and New Jersey). Revise the structure of the CARE Act (e.g., consolidate or eliminate titles).
6. “Medicalize” the CARE Act.
This change would limit allowable services to medical/clinical services, reducing or eliminating essential support services that enable access to therapies and care. This change would disadvantage states that have devoted other resources to HIV/AIDS care (e.g., Medicaid).
(10)

(19)
CARE Act Reauthorization:
Proposals of Concern to New York
(7). AIDS Action ADAP Proposal
Proposes:
ADAP as a separate title. Open enrollment. Open formularies. Portability. Intent is commendable (i.e., improved access to medications and care). However: Real problems associated with fiscal pressures on ADAPs are cloaked in rhetoric (e.g., “streamlining” “modernizing,” and “managed growth”). A positive outcome is entirely conditional upon a doubling of the ADAP appropriation in the next fiscal year and a $100 million increase each year thereafter. Making ADAP a separate title has no value.

(20)
CARE Act Reauthorization:
Proposals of Concern to New York
AIDS Action ADAP Proposal (continued)
Lacks an understanding of existing ADAP programs and issues and proposes programs and activities that are already in place (e.g., create a clinical panel; issue guidelines on formularies; implement insurance continuation programs; allow ADAP funds to be used for lab work and medical monitoring; require a plan for coordination of health care services and ADAP). The recommendation to discontinue “burdensome” rebate programs and purchase drugs through a single federal agency demonstrates a lack of understanding of the drug purchasing, distribution, and rebate systems currently utilized by state ADAPs.
(11)

(21)
NASTAD Principles
Assure that all persons with HIV/AIDS have access to appropriate, high quality health care and support services. Assure that the role of states is recognized. Ensure coordination of publicly financed health care programs. Minimize administrative requirements.
Maintain maximum state flexibility in program design and implementation. Ensure no disruption in services or changes to infrastructure that impact service delivery. Emphasize the federal government’s responsibility to assure equitable access to care.

(22)

NASTAD Recommendations
Retain the current structure of the CARE Act. Include living HIV cases, in addition to living AIDS cases, in the allocation formulas, phased in over a ten-year period. Increase authorized funding levels for all components of the CARE Act. Maintain flexibility to allow CARE Act funds to support health care and support services based on locally determined needs. Do not mandate core services that are more limited than those allowed in the current law. Do not mandate percentage set-asides for specific services or limitations on the amount of funding that can be allocated for an eligible service.
(12)

(23)
NASTAD Recommendations
Revise the hold harmless provision to reflect a 1.5% loss each year (based on FY 05 funding), with a maximum possible loss of 7.5% over a five-year period. Allow states to use funds to serve clients covered by other payers if the services covered elsewhere are difficult to access. Prioritize new Title III grants for underserved states that do not have access to Title I funding and, as a secondary priority, underserved areas of states outside of Title I EMAs.

(24)
NASTAD Recommendations
ADAP: Enhance the availability of ADAP resources for persons with HIV/AIDS in all areas of the nation. Establish a guaranteed level of new funding for ADAP annually. Direct a portion of new funding to states with severe need (e.g., waiting lists, inadequate formularies, restrictive income eligibility). If the annual increase for the ADAP earmark is less than $60 million: Redirect unexpended funds from all titles. Institute an equal percentage tap on all titles excluding ADAP. Direct 80% of annual increases to the ADAP earmark. Direct 20% of annual increases to ADAP supplement.
13

(25)
NASTAD Recommendations
Emerging Communities:
Address inequities in per capita CARE Act funding by revising the emerging communities grants to provide additional Title II resources to states in need. Authorize $35 million in funding for states without Title I EMAs and states in which 50% or greater of their cases reside outside of Title I EMAs. Reduce Title I eligibility to 1,500 cases.

(26)
CARE Act Reauthorization:
New York State Recommendations
Retain the existing framework for Title II funding to states, with the base formula related to cases in the entire state as well as in areas outside of EMAs (i.e., 80-20), and with earmarked ADAP funds as a component of Title II with a separate allocation formula.
Retain hold-harmless provisions that limit the loss of resources to a jurisdiction over time. Revise the allocation formula to include cases of HIV - not just AIDS. Retain the existing multi-title structure of the CARE Act, with ADAP as a component of Title II.
14

(27)
CARE Act Reauthorization:
New York State Recommendations
Continue to fund a range of health care and supportive services. Increase ADAP supplement and award funds based on need. Refrain from mandating specific “core” services; flexibility at the local level is key. Strike region-specific set-asides (i.e., strike “emerging communities” provision of Title II) and reallocate funds to states with severe need.

(28)
Activities to Date
Submitted comments on two occasions to the CDC/HRSA Advisory Committee on HIV and STD Prevention and Treatment. Presented to PACHA. Conducted hill visits to present New York’s issues and recommendations. Presented to New York congressional delegation. Presented recommendations at two national conferences.
Presented to New York State AIDS Advisory Council. Presented to Ryan White Title II network coordinators. Active in NASTAD’s efforts to develop proposals that all states can embrace. Participated in HRSA studies on reauthorization issues.

Sincerely,

Derryck S. It is a complex bill that should be duly considered, not pushed through hastily.

Dear Senator;
As your constituent, I am writing to urge you to make sure that the REAL ID Act of 2005, an anti-refugee bill, is not attached to the emergency spending bill on Iraq and tsunami aid (H.R.1268). It is a complex bill that should be duly considered, not pushed through hastily.

I am glad that the Senate has chosen not to attach REAL ID to its version of the supplemental appropriations bill, and now I hope you will do all you can to make sure that REAL ID is not attached in conference.

I wish to express particular concern about sections 101, 103, and 104 of the bill. Section 101 is titled, “Preventing Terrorists from Obtaining Relief From Removal,” but that makes no sense to me. Terrorists and suspected terrorists are already categorically barred from asylum, as you know, and this bill would not actually protect me, you, or any other Americans from terrorists.

Instead it would place burdens on asylum-seekers that would likely fall hardest on the most vulnerable among them, such as women who have been victims of gender-based persecution. How can a woman who was raped show that her ethnicity, or her religion, was “a central reason” for her persecution? Similarly, the most frightened and traumatized asylum-seekers may be just the ones whose “demeanor” does not strike a judge as credible, since torture survivors often recount their sufferings without apparent emotion.

Section 101 would also increase the burden of proof for some asylum applicants, by allowing judges to require supplemental evidence, and to deny asylum if it isn’t provided. Obtaining such evidence can be difficult for refugees who often flee without their belongings, and who are often put into detention after they arrive here. Finally, asking their family or friends back home to collect the evidence often puts them in danger.

I am also worried that immigrants, including asylum-seekers and asylees, could be wrongfully deported under the extremely broad definitions of terrorist activity in Sections 103 and 104.

The definition of terrorist organizations includes a “group of two or more, whether organized or not” or a subgroup of such a group that is involved in vaguely defined terrorist activities. And section 103 would create an impossibly high standard, requiring immigrants to prove by “clear and convincing evidence” that they did not know that an organization with which they had some association was involved in broadly defined terrorist activities.

This is a virtually impossible level of proof because it would require a person to prove what they did not know, so immigrants would be unable to defend themselves against a mistaken accusation.

Section 103 also penalizes people for espousing or endorsing terrorist activity. This broad language extends beyond conduct and has the potential to infringe on a person’s freedom of speech. To verbally endorse an activity is currently well permitted in the Constitution of the United States. The bill in its current form imposes dangerous penalties on freedom of speech in this country.

I hope that you will consider my concerns as the Senate negotiates with the House on whether to include REAL ID in the supplemental spending bill.

Sincerely,

Derryck S. John McCain, R-Ariz., and Edward Kennedy, D-Mass. It would create a temporary-work visa program for foreigners to fill jobs requiring few or no skills, for up to six years.

The legislation was touted as ensuring tougher enforcement of laws at the border and in the workplace while speeding the process of reuniting immigrant families. In addition, Mexico and other countries would be encouraged to enter into agreements to play a more active role in helping prevent illegal immigration into the United States, including promoting more economic opportunity back home.

House sponsors Jim Kolbe and Jeff Flake, both Arizona Republicans, and Luis Gutierrez, D-Ill., joined McCain and Kennedy on Thursday in casting the legislation as a comprehensive approach to immigration reform and national security. They also said they believe it is consistent with the broad principles that President Bush said he'd favor in a temporary-worker plan to "match willing employers and willing workers" from other countries. In fact, Bush has offered few specifics for what he wants in such a proposal.

Immigrant advocates and some business groups, including the U.S. Chamber of Commerce, said they welcomed the measure as a broad approach to immigration reform that goes beyond the piecemeal efforts of the past. But the legislation faces an uncertain future because of stiff opposition from groups that want tighter immigration controls - including many Republicans who hold a majority in the U.S. House - and that oppose giving legal status to people who've entered the country illegally.

There is, however, widespread recognition in Congress that the current immigration system is broken, despite disagreement over priorities. "I want an immigration system that says we're not going to look for people who come to mow our lawns, and wash our dishes and clean our babies' behinds and raise them. Those aren't the people we're concerned about," Gutierrez said. "We're concerned about drug dealers and smugglers on our borders."

But Arizona Republican Rep. J.D. Hayworth, who supports tighter controls on immigration, criticized the bill as a "bad idea not only because it creates a transparent path to amnesty, but also because it would reduce work opportunities, depress wages and lower worker protections for Americans." "I believe that when the disturbing details of this proposal are considered, Congress will see the light and join the overwhelming majority of Americans that want the federal government to enforce our present laws against illegal immigration," Hayworth said.

Bush administration spokesman Taylor Gross on Thursday offered no clue as to how the new bill was being received at the White House. "The president is glad to see this contribution to the discussion on immigration," Gross said, though he added, "We understand a number of other members are working on proposals, as well, and we look forward to working with members of both parties to pass a bill that meets the president's principles."

McCain assured that the measure "is not, I repeat, NOT, an amnesty bill," noting that, "The reality is there is an estimated 10 (million) to 11 million undocumented people living and working in this country. It would be impossible to identify and round them up and send them back to the countries from which they came." Insisted Kennedy: "This bill does not provide a free pass to anyone. This bill does not put those who have been illegally here in the
United States at the front of the line."

The legislation aims to enable undocumented workers to come forward to apply for one of two new visas - called an H-5B - for work status as a "non-immigrant." Under this visa, they could not only work in the United States for up to six years, but also could travel abroad. To obtain this status, workers would have to submit to fingerprinting and other background checks, pay processing fees, back taxes and a $1,000 initial fine. The worker's spouse and children also could apply.

After six years, the worker would be limited to five more years to make it through the waiting list for a green card. To eventually apply for this permanent resident status, the worker also would have to pay an additional $1,000 fine, undergo more criminal checks and a medical exam, register for selective service, and work to become proficient in English. The spouse and children also could apply for permanent status.

The bill also would create a new temporary visa to allow foreign workers to enter the country, dubbed a H-5A visa. All applicants would have to show they had a job waiting for them and pay a fee of $500, in addition to clearing all security, medical and other checks. These visas would be "portable" to other jobs, and the total number of applicants initially would be capped at 400,000 annually.

Employers who apply for foreign workers would first have to advertise those jobs on a national electronic database and give priority to U.S. workers.
Under the bill, a new visa document would be tamper-proof and include biometric information. The system would allow employers to verify electronically that a foreign worker is in the country legally and authorized to work. Any employer who participates in the program would be required to use this system; the measure would bring stiff fines on employers knowingly violating immigration labor laws.

It also calls for a commission that would evaluate the impact of the legislation on the U.S. labor market "We need a plan that fairly balances national security, economic reality and worker protections, and I think our bill comes pretty darn close," Flake said.

Added Kolbe: "This is a comprehensive bill that doesn't try to solve the hemorrhaging immigration problem with a Band-Aid. This is major surgery." McCain said he was optimistic that the Bush administration would work with lawmakers on the immigration proposal and that there would be hearings on it this year. There was no immediate reaction from Sen. Jon Kyl, R-Ariz., who with Sen. John Cornyn, R-Texas, is expected to introduce his own bill by the end of the summer to make it easier for foreigners to work in the United States temporarily. But they oppose making it easier for those who already are in the country illegally to gain permanent residence.

Frank Sharry, executive director of the National Immigration Forum, an immigrant advocacy group, said, "This bill will reconcile the fact that we have hardworking immigrants already here and coming in the future, but insufficient legal channels. "This bill gets the combination of admissions and enforcement just about right. In contrast to the status quo, it will mean honest admissions policies, tightly enforced," he said. Randal Johnson, the U.S.

Chamber of Commerce's vice president of labor, immigration and employee benefits, said the nation's immigration and visa policy "must improve our nation's security, address future labor shortages through a temporary-worker program and provide a reasonable mechanism for undocumented workers already here to qualify for legal status."

"While some significant issues remain to be resolved, this legislation meets those principles," he said. But Jack Martin, special projects director for the Federation for American Immigration Reform, a group that advocates improved border security to stop illegal immigration, said, "There's an amnesty component to this, whether they want to call it that or not."

END.
Reach the reporter at billy.house@arizoanrepublic.com or at 1-(202)-906-8136.

Hilary Clinton against Illegal Immigration:

                 Hillary Clinton Against Illegal Immigration?
Dec. 14-2004:

Sen. Hillary Clinton is seemingly taking a hard-line against illegal immigration and is being lauded by Conservatives for the position. The Washington Times yesterday cited at least two instances in recent weeks, when the New York Senator has stated her tough stance on the issue.

These reportedly include an interview last month on Fox News last month when Clinton said she does not "think that we have protected our borders or our ports or provided our first responders with the resources they need, so we can do more and we can do better." And in an interview on WABC radio, she said, "I am, you know, adamantly against illegal immigrants," according to the Washington Times.

"Clearly, we have to make some tough decisions as a country, and one of them ought to be coming up with a much better entry-and-exit system so that if we're going to let people in for the work that otherwise would not be done, let's have a system that keeps track of them," the paper quoted her as adding.

Rep. Tom Tancredo, a conservative Colorado Republican, who has been a staunch backer of tighter immigration policies, has taken notice. "She's not a dumb woman," Tancredo spokesman Carlos Espinoza told the Times. "She's got a great liberal base, and she realizes there's no better way to draw in more conservative voters. She has really come out to the forefront on that."

Meanwhile, in a statement on the passage of The Intelligence Reform and Terrorism Prevention Act of 2004, Clinton stated, “While I look forward to a productive debate on immigration issues in the next Congress, I am pleased that there are a number of key immigration reform provisions in this legislation, including those addressing the process of obtaining U.S. visas.”

The move is being viewed by Conservatives as a welcome ploy to pull in more voters from Republican states, should she run for President in 2008.

END:
Hardbeatnews.com

Are You Preparing To Visit Guyana?

To:Guyanese@yahoogroups.com

Date:Sat, 22 Nov 2003 17:30:23 -0000Subject:[Guyanese] Visiting Guyana?

Check out The U.S. Department of StateBureau of Consular AffairsWashington, DC 20520Consular Information Sheet
This information is current as of today, Fri Nov 21-12:18:06 2003. That was under his watch!

When AIDS was ravishing millions in the continent of Africa, Bill Clinton did not aggressively inject money or medication to help alleviate the pain, suffering and death of those desperately poor and undeveloped states in Africa, that was reeking under this pandemic.

It was under his watch that The Immigration Laws that were introduced in 1996-97 that inhibited legal residence, eg P.R.U.C.O.L. The broadcast was pulled on Friday, September 21, 2001 following objections from the US Deputy Secretary Of State and senior officials of the National Security Council.

Voice of America interviewer: Why don't you expel Osama Bin Laden?
Omar: This is not an issue of Osama bin Laden. It is an issue of Islam. Islam's prestige is at stake. So is Afghanistan's tradition.

VOA: Do you know that the US has announced a war on terrorism?
Omar: I am considering two promises. One is the promise of God, the other is that of Bush. The promise of God is that my land is vast. If you start a journey on God's path, you can reside anywhere on this earth and will be protected... The promise of Bush is that there is no place on earth where you can hide that I cannot find you. We will see which one of these two promises is fulfilled.

VOA: But aren't you afraid for the people, yourself, the Taliban, your country?
Omar: Almighty God... is helping the believers and the Muslims. God says he will never be satisfied with the infidels. In terms of worldly affairs, America is very strong. Even if it were twice as strong or twice that, it could not be strong enough to defeat us. We are confident that no one can harm us if God is with us.

VOA: You are telling me you are not concerned, but Afghans all over the world are concerned.
Omar: We are also concerned. Great issues lie ahead. But we depend on God's mercy. Consider our point of view: if we give Osama away today, Muslims who are now pleading to give him up would then be reviling us for giving him up... Everyone is afraid of America and wants to please it. But Americans will not be able to prevent such acts like the one that has just occurred because America has taken Islam hostage. If you look at Islamic countries, the people are in despair. They are complaining that Islam is gone. But people remain firm in their Islamic beliefs. In their pain and frustration, some of them commit suicide acts. They feel they have nothing to lose.

VOA: What do you mean by saying America has taken the Islamic world hostage?
Omar: America controls the governments of the Islamic countries. The people ask to follow Islam, but the governments do not listen because they are in the grip of the United States. If someone follows the path of Islam, the government arrests him, tortures him or kills him. This is the doing of America. If it stops supporting those governments and lets the people deal with them, then such things won't happen. America has created the evil that is attacking it. The evil will not disappear even if I die and Osama dies and others die. The US should step back and review its policy. It should stop trying to impose its empire on the rest of the world, especially on Islamic countries.

VOA: So you won't give Osama bin Laden up?
Omar: No. We cannot do that. If we did, it means we are not Muslims... that Islam is finished. If we were afraid of attack, we could have surrendered him the last time we were threatened and attacked. So America can hit us again, and this time we don't even have a friend.

VOA: If you fight America with all your might - can the Taliban do that? Won't America beat you and won't your people suffer even more?
Omar: I'm very confident that it won't turn out this way.
